is my son elgible for OCI or PIO ?

Post by ukbuddy » Wed Jul 11, 2012 11:41 am

Hi

My son is born in UK and after that I got ILR. I have got his naturalization done and now in process of getting his British passport.

Both me & wife are still on ILR and not eligible for British citizenship yet. So can I apply for our 2 year old son's PIC or OCI card ?

Which one will apply to him (he is a minor).

If both parents are Indian, he can only apply for PIO (Person of Indian Origin). Once any of you get British Citizenship you can apply for his OCI.

PIO is valid for 15yr and if he is staying for more then 180 days in India, you need to register him at FRRO (Foreigner Regional Registration Office)

I will take back last sentence about need to register at FRRO.

ref: official homeoffice India site "For minor no registration is required on any type of visa."

Last sentence of 2nd point under registration. www.immigrationindia.nic.in.
