Tier 2 visa 6 wks no answer!

Post by iphone10 » Thu Jul 12, 2012 3:38 pm

What does a no decision has been rendered on Tier 2 visa application filed in the US after 6 weeks have already passed?

In their initial emails the UKBA said that %98 of applications ends in 6 weeks. But if no decision is made after this date, does it mean something is wrong, and rejection is likely? What are my options at this time in terms of ways to get more information from them? I have a serious British sponsor and I have good grade in points system. I have been reading many of the posts published on this board that might have some resemblance to my situation and they helped me great deal. As you can understand, waiting for such a decision is very stressful. I would appreciate any feedback on this.

A decision has been rendered means a decision has been made, but, unusually, they are not saying if it is positive or negative outcome. Was this email sent by the fco.gov server or the worldbridge server?

clarification

Thanks for the reply. It seems that my post was not that clear. I actually did not receive a response from UKBA after the 6 weeks have passed. My question is how you guys perceive the delay? Is it a sign of refusal? Or the delay is normal? Again, i am applying from the USA.

You are well outside the expected processing time for visa applications made in the USA. However, everyone is different so it's not possible to know the reasons for such a long delay without knowing you, your immigration history, your sponsor, the points you are claiming, on what basis you are claiming them, etc. In short, you will not get an answer on a forum and the UKBA will not comment on your request for information until 12 weeks have lapsed.

Thanks again. But from your experience and knowledge do they usually wait 12 wks before they send the refusal note?

They don't say if a visa has been refused by email. They will say that a decision has been made and your passport is ready for collection (or is being returned to the VAC for your collection). 12 weeks is a performance target by which they aim to clear outstanding applications, but it could be more and it could be less, so it is not a definite threshold by which time you will be contacted. What I meant in my previous post is that they will not generally consider responding to your requests for an update until after 12 weeks.
