General or Family vistor

Hi guys,

I am trying to call my brother and mom over to uk on a causal visit. My brother has previously applied for tier 1 and got rejected because of insufficient points.

I am thinking would it cause any issues if I call him as family visitor. Will I be better off calling him as general visitor ?

Also if they come as family vistor. will there be any restrictions .. for example I am planing to apply for schengen and take them around for euorpe trip..family vistor visa section says you can not use this visa if you are on transit..

If your family are intending to visit you, they should apply as family visitors.

What do you mean to ask here? The question needs a bit more clarity. Note that if your family visitors want to travel to any of the Schengen states in Europe they will need to apply for Schengen visas before arriving here. I.e. A UK visit visa will not give them entry to the Schengen area. Unless ofcourse they hold passports that permit visa-free entry to the Schengen countries you intend to visit.

Thanks "cs95tdg". Sorry for bieng bit vague on the question.

My question has two parts.

1) My brother was previously rejected visa to uk. This was because he did not had enough points for tier 1. Will this have any bearing at all when case worker decides the visitor visa case. As the previous visa application was for working in uk, the caseworker may naturally suspect he may come down and start working here. If he shows he has a his brother staying here (and apply for family visitor), it may give add up to the suspicion, making our case of family visitor harder to defend and We may have to produce more proofs to prove that he will return to home country.

He currently has

- Letter from his employer in home country
- His car ownership details back in home country
- Some funds in bank account
- Does not have any properly or anything in his name


Instead if we chose general visitor route and does not show that he has a brother living here, will this make the visitor visa case straight forward and easy to defend ? His main purpouse of visit anyway is to roam around uk and see Olympics. We have Olympic tickets as well.

2) Both my mom and brother will be applying for schengen before coming to uk.

I read in family visitor visa rules that, this Family visitor visa can not be used if they are in transit to another country. Will this mean a restriction not to visit other countries and come back to uk? or just for transit from your experience?

I would personally stick to the truth and apply as a family visitor. The ECO will look at your brothers past immigration history, the onus is on him to prove that he intends to return to his country of residence after the visit irrespective of whether he applies as a general or family visitor. The more proof the better & from what I can see from the above evidence the key will be his employment. Note that your mom will also need to provide evidence of her ties to her home country as well. (Do include evidence for return travel as well)

Note that the UKBA will have immigration history for all of you & they will look at that irrespective of the type of visa your mom & brother apply for.

In addition to providing evidence of their intent to return, they will both need to provide evidence of their ability to maintain themselves while in the UK.

Transit here means if transiting through the UK to go to another country, i.e. because your flight plan has a stop in the UK. But this won't be the case here (unless you say otherwise). What both your mom & brother will need is a multiple or dual entry visa (I'm not sure what options they currently have on the visit visa form) to allow them re-entry into the UK after their visit to Europe, i.e. if they will be coming back to the UK before they both finish their holiday here.

Thanks "cs95tdg" for the detailed reply. We will collect as much evidence possible and will apply for the visa. Thanks a lot for guidence. Will let you know the outcome.
