Clarification sought regarding Tier 2 change of sponsors

Post by mhabib » Fri Jul 13, 2012 10:48 am

Hi, I'm currently on a Tier 2 ICT and came to the UK in Feb 2010. I've received a sponsorship from another company and have booked a premium same day appointment for me and my dependant on the 14th of August.
My UK engagement with the current sponsor finishes on the 31st of July and they want me to shift back. Is it possible for me to a.) continue staying in country till my appointment on 14th August. The current sponsor will cancel my Tier 2 ICT (valid until April 2014) within a weeks time after the 31st of July. b.) Is it possible for me to serve my notice period to my current employer, or should I wait till 31st July?

Thanks in advance.

There will be no problem with staying in the UK to attend your PEO appointment on 14 August.

When your current sponsor informs UKBA that you ceased working for them on 31 July UKBA will curtail your visa to 60 days from the date they make their decision to curtail (not from 31 July), i.e. you can stay in the UK on your current visa at least till 1 October and some time beyond. By that time hopefully you will have got your Tier 2 General leave to remain.

This is the immigration position. Your employment contract is a different matter. Your last question is not understood.

Thanks. Also, Will I be eligible for an ILR, or is that not possible currently?

As you have been in theT2 ICT category since before April 2010, and provided your visa was not multiple-entry, you will be eligible for ILR after 5 years continuous lawful residence subject to satisfying the other requirements for settlement. Time under your new Tier 2 General leave will be aggregated with time under T2 ICT.
