ILR and child registration doubts.

Hi All,
I'll be applying ILR with my wife in next 2 months and would be skipping ILR for my son who was born in UK (in april 2010). So it'll be MN1 application process for my son.

I got following doubts:

1) I understand once I get ILR, I'll apply MN1 application for my son, and I'll get registration certificate for him. and I believe the next step is to apply for British passport(http://www.direct.gov.uk/en/TravelAndTr ... /DG_174107)? Is this correct process? is there any citizenship ceremony for children?

2) I understand a UK born child's application for registration, (where child's parents get the ILR after child's birth), is an entitlement under section 1(3) and as such the HO has no discretion in the decision if the statutory requirements are met.
So does this mean child is almost guaranteed to get registered as British citizen? Basically I want to know if I have to take care of any special requirements (like maintaining funds etc) just to make sure application doesn’t get rejected?

It’s an entitlement for UK born children and Home Office in not very strict with these applications. Your child will have no issues in getting registered as a British Citizen. I just got the certificates for my 2 children and in total, it all took 1 month and 21 days.

2) I believe child cannot travel outside UK without British passport once the registration certificate is recieved? My son currently holds Indian passport.

Your assumption is correct ilrcoming. Once you get your own ILR, you need to register your son as a British Citizenship under Section 1(3) using form MN1. Kids of this age don’t have to attend the ceremony and the certificate comes at home. You can also take benefit of NCS (Nationality Checking Service) which most of the councils offer. You don’t have to use your council. If you send your application through NCS, then they amke copies of all docs and return everything to you including the passports.

They also verify that the application form is complete and you are providing all the relevant documents. Once you get your child’s British Citizenship Certificate in post, you need to apply for his passport via post office, by post or using the fast track 1 week service by IPS.


India doesn’t allow dual citizenships, so you will have to be very careful when your child travels. Ideally he needs to apply for PIO card from Indian High Commission London as soon as he becomes British Citizen.

How long did it take to get passport after getting certificates for children?

Somudro: I was myself exploring options for my kid’s passport and I think the 1 week fast track service is the fastest way to get your child’s passport. But if you don’t have urgent travel plans, then I would suggest you send the passport application at one of the post offices using Check & Send Service, which normally takes 3 weeks.

Adults who never had British Passports before can’t use this service but the children can.

I meant Adults (for first passport) can’t use 1 day Premium or 1 week fast track service, but they can use Post Office Check & Send service or can send the application by post.

linkers, I agree with that. Even an adult who has not had an Adult passport before can use the Post Office Check & Send service.

Hi,

I am in the same boat indeed.

I have an ILR which was granted December 2011. And then my daughter has now received the British Citizenship certificate as well.

However, a slight confusion. There is a section in the Passport Application form which seeks proof of parents being British / British descendants ... which we are not obviously.

Can I go ahead and apply for a British Passport for my daughter in the fast-track mode (or even normal mode) ?

I suggest you read the passport guide.

There isn't a section which seeks proof of parents being British. There is a section on parents' details. It the child has a registration certificate (section 5), then parents nationality is not relevant.
