Information regarding ILR

Dear All

I am on tier1 general visa and would like to go for ILR in November this year.
I got my first tier1 visa in November 2007 and traveled to the UK in Feb 2008 which is after 94 days after I got the visa.

The rule says that the person has to travel in 90 days after getting the visa. Will the case worker consider 94 days if the reason is valid and with the valid proof.

Please suggest.
