Change of sponsor for Tier 2 residence permit

Post by sifar_start » Tue Jul 17, 2012 1:20 pm

I have UK residence permit (T2 Inter company transfer) issued in UK on 25/07/2011 and valid up to 29/08/2013. I came back from UK to India in October 2011 and changed the Job/Employer.
I have following two queries:

Q1. Is that my UK residence permit still valid, since I have changed the Job / Employer?

Q2. In case residence permit is not valid , then is it possible to apply for change of sponsor for my residence permit?

Thanks!!

When you left your sponsor's employment in October 2011 they should have reported this to UKBA and, if they did, your leave would have been curtailed. If they did not report it they were in breach of their sponsor duties.

Since you are not sponsored at present your residence permit and entry clearance are no longer valid.

If you wanted to return to the UK to work you would need a CoS assigned to you by an employer and then apply for entry clearance. However, you can only apply after 12 months have passed after the expiry of your previous leave (cooling-off period)

You would need to make a fresh application for entry clearance after the end of the cooling-off period and after have had a new CoS.

Check whether your leave has been curtailed after you left your sponsor's employment in October 2011 because the 12 month cooling-off periods starts from the expiry of that leave. If your former employer failed to informed UKBA that you left them make sure that they do so as soon as possible.

Cooling-off period would be applicable if you wanted to return to the UK in the Tier 2 General category but not if you were to apply in the Tier 2 ICT Long Term Staff category.
