Salary reduction and subsequent effect on Tier 1 Extension

Post by Saga » Thu Jul 19, 2012 11:41 am

Hi all,

I have a question.

I am in a situation where due to financial circumstances, my employer is undergoing a 10% salary reduction across the board for 6 months .

The employer is willing to give a letter of what the original salary is.

My questions are:-

- Will my salary be counted as reduced because of the paycut and subsequent reduction in points? or will the salary be still counted as the original one and I can claim points?

- Can I pick and choose the months from last 15 months before extension due date to try and get into the max salary band I can?

Many Thanks

The salary (previous earnings) that you can use towards your PBS points will be whatever that appears in your payslips for the time period (i.e. 12 consecutive months within the 15 months prior to your application) you decide to use for your extension application.

A letter from your employer indicating your original salary will not have an effect here, as it's the actual earnings you made during the period that counts.

You can't pick and choose any months from past 15 months as it has to be 12 consecutive months. With regards to salary reduction, they will check monthly gross what you will get paid so yes it will affect you. So if your payslips will reflect your gross income which is 10 % less then Case worker will consider whats on your payslip.

I would suggest you consider the first 12 months of the 15 months, for your earnings. That way you will get maximum benefit. Good luck mate.

In addition to the above posts, the key thing you need to concern yourself with is do you qualify for the visa with the salary you earn?

The Home Office does not care if your salary reduces or increases, they care that you meet the points threshold to qualify. If you meet the points threshold, then you qualify. It is as simple as that.

Kind Regards

Thanks for replies.

I was waiting for the payslip itself and it does actually state the original income and the 10% reduced gross income.

Now on the timeline, does past 15 months include the ongoing month?

If I want to renew in March 2013, can I show payslips from Jan '12-Dec '12?

regards.
