can ILR dependant get Maternity Allowance (MA)

My friends wife recently start working for a firm and now she is pregnant but her firm confirmed her that she is not eligible Statutory Maternity Pay as she haven't earn enough salary and now she has been given SMP1 form to get Maternity Allowance (MA).

Is she eligible to get Maternity Allowance? she is on ILR Dependant visa.

She is entitled to claim it as it does not constitute public funds but whether she does get it depends on her earning history. If it's very new job (as you indicate) and she has been working for less than 13 weeks she will not be entitled.

she has been informed by work and pension department that she is eligible for Maternity Allowence but will it effect her ILR application as she is still under immigration control as she is ILR dependant/

Not true.

If you have a visa that allows you to live and work in the United Kingdom you may be able to get Maternity Allowance. If your visa includes the condition that you have “no recourse to public funds” you may still get Maternity Allowance. You will need to satisfy the qualifying conditions. The qualifying conditions for Maternity Allowance depend on your recent employment and earnings history. Because of this Maternity Allowance does not constitute public funds.
