Bringing baby to UK from India

Post by amoghdhamankar » Thu Jul 19, 2012 11:46 pm

Hi,

Many thanks for the very informative forum. Much appreciated.

Background:

My second daughter was born in March 2012 in India. Both me, my wife and my elder daughter have ILR since June 2011. In November 2012, I plan to bring all of them in UK. I have not yet applied for her Indian passport in Mumbai

Question:
1) Can I directly apply for my second daughter's British Citizenship from Mumbai (She was born after our ILR in Mumbai)
2) If not, which form should I fill to bring my second daughter in UK? VAF4A? or any other form for Entry Clearance?
3) My elder daughter's passport expires in March 2013 and we plan to travel back to UK in Nov 2012. Will this be an issue?

Any guidance much appreciated as always.

1) No. As she was born abroad, she can only apply for citizenship when you apply for it. See Q1 in Citizenship FAQs - Common Questions - Read before posting - Children.

2) Yes. See Children settlement.

3) No. She can enter as long as the visa is valid (even if passport expires the next day).

Many thanks Jambo.

A quick check. Which paper appendix should I use for my daughter's VAF4A application?
According to UKBA site, both paper Appendix 1 and Appendix 2 state this criterion -
The child of settled parents or with one parent who has limited leave as a partner or parent granted under the Rules in force before 9 July 2012.

I am settled (ILR) in June 2011

However, on the online application site (visa4u.co.uk), Appendix 1 does not state the above criteria. Its only Appendix 2

I am confused and any guidance is much appreciated.

No idea. I suggest you ask in the Immigration for family members dedicated section.

can I bring my daughter to UK on a VISITOR VISA (6months) and then immediately apply for her British Citizenship along with mine?
We both (me and my wife) have ILR. She was born in India and have Indian passport at the moment. This could significantly save money for us by not applying for my daughter's ILR in India (VAF4A Form)
Any advice?
