This is Ananth from India required help regarding TEIR2 intercompany transfer VISA under short term skills transfer.Whether I can apply for extension of VISA from India under same category as I not yest entered UK.
I received visa under mentioned category valid from 18/04/12 to 08/09/2012.This validity(only 5months) based on COS raised on Jan 2012 and when I was not completed 1 year of time. Now the requirement for travel for skills transfer got cancelled. And new requirement came to travel short term for 1 year.
As now I not entered UK with current VISA. Now I completed 1 year 4 months and eligible for short term visa and for maximum of 1 year validity for new requirement in UK.
Whether I can apply for VISA again under same category(tier2 short term 1year) immediately before expiry of current VISA I was not entered UK?
I spoke to UKBA agency 6-7 times on 0870 606 7766.And getting the news that I still can apply for short term as I was not entered UK.
But from below rulesforTier2 giving diffrenct idea.
Could you please help me whether I can apply for short term VISA now immediately.
26. Please note that for those who had successful applications for leave in one of the following
categories:
• a Tier 2 (Intra-Company Transfer) applicant in the Skills Transfer sub-category will
be granted leave for no longer than 6 months; at which point you must leave the UK
and you will not be able to re-apply for further leave under an Intra-Company Transfer
category (other than in the Long Term Staff sub-category) until 12 months after your
last leave as an Intra-Company Transfer expired.
• a Tier 2 (Intra-Company Transfer) applicant in the Short Term Staff or Graduate
Trainee sub-categories will be granted leave for no longer than 12 months; at which
point you must leave the UK and you will not be able to re-apply for further leave
under an Intra-Company Transfer category (other than in the Long Term Staff subcategory)
until 12 months after your last leave as an Intra-Company Transfer expired.
• a Tier 2 (Intra-Company Transfer) applicant in the Long Term Staff sub-category will
be granted leave up to 3 years with the possibility of extending for a further 2 years.
You will not be able to extend beyond 5 years and you will not be able to re-apply to
return to the UK under an Intra-Company Transfer category until 12 months after your
last leave as an Intra-Company Transfer expired.
27. These periods are based on the leave you were granted, not the time you spent in the UK.
For example if you successfully applied for 12 months leave in the Short Term Staff subcategory,
but did not actually come to the UK, you cannot be granted any more leave under
the Short Term Staff sub-category until 12 months after your previous leave expired.
