Dependent visa close to Tier 1 expiry

Hi all,

I am on Tier 1 (G) visa expiring on Feb 2013. I am getting married in October 2012. I will be applying for dependent visa for my spouse after marriage.

Here are my questions.

1. As you can see, i will have only three months left in my Tier 1 visa while i apply for dependent visa, Do you think there are any chances of dependent visa rejection citing the reason primary visa expiring is nearing soon?

2. I will be eligible for ILR by Feb 2013, I will have to apply for my spouse visa again. What will be visa category for her?
I know about the 5 years probationary period before my partner is eligible for ILR.

There is a good chance, that by the time your wife's visa makes progress in the que of applications, your visa in UK would have already expired. And anyways, what's the point of paying hefty application fees twice, once in India and then very shortly here in UK.
Why not just wait till you get ILR, and then your wife applies for visa. This way there wont be uncertainties, will cost less, less grief and less running around.

I thought it would take only 2 weeks to get Tier 1 Dependent visa. I do not want to leave her back in india for 3 months waiting for visa.
Any other solutions please?

I could understand your situation !

Your chances of VISA rejection is very high for dependant VISA. ( Huge fee ... no refunds )

What I suggest is that you can apply for a visitor visa for her right now. ( you should have minimum of six months visa ) You can have your wife in UK after marriage and then you apply for your ILR and then her Dependant VISA.

Hope this gives you an idea.

Thanks for your responses.

I need to think whether to apply for Visitor visa or Tier 1 Dependent visa or ILR dependent visa.

Is ILR dependent visa application from India any different from Tier 1 Dependent visa in terms of application form, documents required and maintenance?
Is it the same online application form as Tier 1 dependent?

YES , you cannot change from visit visa. You can change only in ILR dependent or Tier -1 dependant.

Now all their normal processing is delayed. Pls take a note on this info.

1. No.
2. She may extend leave as PBS dependant even at that time (319C), and continue to do so until she becomes eligible for settlement - irrespective of your status (ILR / BC) during the interim years.

Both of our visas will expire on Feb 8 2013. I will be eligible for ILR by then and she would have spent three months as Tier 1 Dependent.

You mentioned the she can extend her leave as Tier 1 dependent. To qualify for this, Should she apply for Tier 1 dependent extension before I apply for ILR or anytime after I get ILR?
