Can Cont Based ESA be used towards the finaical requirement

Can Cont Based ESA be used towards the finaical requirement

I am a bit worried as when we submitted the Fiance Visa application (pre July 9th) I have used my Cont Based ESA as a souse of meeting the financial requirement as in that I can use that to support my Fiance.

Income from the following sources will not be counted towards the financial
requirement:

Contribution based ESA

Cont ESA is not considered as public funds.

So I am worried that I can not use my ESA COnt towards the financial requirement? I am trying to find out if Contribution BASED ESA was for certain allowed to be used to meet the maintenance requirement before July 9th so that I know I am still ok?

Whatever the case may be, does it make a difference?

Your spouse has applied. So do you have a plan B to somehow meet financial requirements in some other way?

You will know the definitive answer to all your queries when the application is decided.

What is the point now in pondering over what you submitted was sufficient or not?

I still am interested to know if Contribution based ESA can be used to meet the finacial requirement of an Application now under the new rules and if it could be used under the OLD Rules?

Although I see in the New Rules it can not, but its strange as they still have the same website

PAge 44, it says it can not be relied on as Financial Support? So its got me a bit confused as I am sure there are other people now under the new rules who will be thinking, OK here it says its not a public fund and here it says it can not be relied on?? can I or can I not use my contribution based ESA for my Application. Anyone any ideas? Thanks

Without digging too deep into the new rules and having a prolonged dialogue about them, in a nutshell, under new rules its immaterial which benefit is regarded as public fund and which is not.

The bottom line is, an applicant has to meet the requirements by the means and documents given in annex FM. Anything not mentioned in there is out, without anymore arguments or debates.

So annex FM is your bible now, and not the research about what is public fund and what is not.
