URGENT :Tier -1 Dependant in UK, Want to apply for FLR(M)

Post by tamilmaran » Mon Jul 23, 2012 8:19 am

My wife and KID have applied for ILR in Croydon office ( Premium service on 5th July appointment at 10:50).Biometrics done by 11:30.Informed System was slow, so documents checked by 4:30. Asked to submit additional documents which was promptly done. Now three weeks later, still not heard from UKBA. Anxious days and sleepless nights.

More problem, because, I am on Tier -1 dependent ( and as I have not completed 2 years, could not apply for ILR )

My current dependent visa runs out in two weeks. My burning questions are

1. What will happen if my wife's ILR does not come in two weeks time- do I have to leave the country and re apply from outside UK ? Has anyone done this?

2. If her ILR gets rejected ( one absence over 90 days for medical reasons- but who knows what UKBA finds acceptable?) Does she have to apply for Tier 1 extension?

3. Most importantly, if this decision comes after her current leave to remain expires, what is her immigration status? Will she still be able to apply for Tier 1 extension from here ?

Extremely anxious as getting closer to the date .... immediate advice on this is highly appreciated

Regards

To start with you will have the following two options:

1) Extend your dependent VISA - You will need to do this if your wife does not get an ILR. At the moment you can only do this because your wife has not been granted ILR yet and thus on her current VISA status until she gets the ILR.

2) Apply for FLR - Once you wife gets ILR, you will need to apply for FLR and then completing your 2 years apply for ILR.

From what you have posted, I would suggest that you complete your paper work for both of the above applications. If you do not hear by the end of the week about your wife's ILR, I would suggesst that you extend your current VISA (option 1). If you get a good news (hope so), you can apply for FLR.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

Thank You harv,

The problem is that her visa also expires on 1st week of August. That is the reason we went for Premium service, so that we would come to know the outcome.

I cant apply for my extension of visa or FLR(M) without knowing her status...
