ILR Application in UK – Hungarian Spouse- unspent conviction

Hello All,
I am an Algerian national and my wife is Hungarian, I currently have a 5 years residency in the UK as a family member of an EU national (my wife) So this was through EU Law. I have a conviction which will be spent 1 year after my application for ILR will be due. My solicitor is telling me that the conviction won’t affect my ILR application because I will apply through EU law and not UK immigration law and because it is minor and nothing serious. I am still worried.
Your help would be really appreciated. Moderators/Senior Members, please advise.

Forget about ILR. You are not going to get ILR. ILR is granted under UK immigration rules. So, stop looking at the information about ILR.

What you will be applying for is PR or Permanent residence under EEA regulations. Listen to what your solicitor is saying.
