Hi

I am on a Tier 1 (General) visa valid until Jun 2013. I have been in UK for more than 5 years (entered UK in Apr2007). My wife has been staying with me in UK for more than 2 years on PBS Dependant visa (entered UK in Mar 2010). I now want to apply for ILR along with my wife and I am not sure if we are affected by the new rules that have come into effect from 9th July 2012. As I understand we both are eligible to apply for ILR under the old rules as I have competed 5 years in UK and she has been staying with me for more than 2 years (we both are OK on the income front), but not sure if that is still the case.

So if I go for ILR now, will the new rules affect my wife's ILR and will she come under new rules i.e. will have to wait for another 2+ years (to complete total 5 years stay with me in UK) before she can apply?
or
can she still apply for ILR next month along with me as per the old rules?

Just do not even think about new rules. They do not effect you at all.

Also am I right in thinking that as per the old rules, my wife will first have to switch to FLR(M) when I apply for ILR, and then she would be able to apply for ILR for herself using SET(M)?

According to old rules? Where is it mentioned in the old rules, that you are saying is in old rules?

Your wife applies for ILR as your dependant.
