ILR - 28 days rule

Hi All,
This is a query regarding the earliest date I can apply for ILR/Naturalisation.

Entered in UK- 03-12-2007
Entry Clearance was from- 03-12-2007 to 03-12-2011 based on 4 yrs work Permit
Changed to Tier 2 ICT in Oct 2011 and Visa extended upto 03-12-2013

I am looking for applying for ILR this year. The earliest date I think I can apply is 05-11-2012 ( 28 days from 03-12-2012)

I am thinking of a PEO appointment on 5th NOV 2012.

Am I doing the calculation correct?

Also Can I aaply for Naturalisation on 05-11-2012 ?

Any help is appreciated.

Eligibility for naturalisation is 1 years after receiving your ILR.

Hi,

I came over here on 4th Nov, 2007.

Can you please confirm if 8th Oct, 2012 looks good for ILR eligibility and take the appointment?

Using the link below, i see 8th Oct, 2012 should be good for me.

is that when visa expires 03-12-2012?

if that is true then 5 Nov 2012 is fine.

Visa entry clearance in passport: 15th feb 2008 to 15th feb 2013
First uk entry in heathrow: 28th feb 2008

Does it mean the earliest I can apply is 13th jan 2013?

Everything else remaining in 'qualifying' order, you CAN apply during the 28 days prior to the 5th anniversary of your intial eligible entry to the UK.

If your initial EC (15th Feb 2008) was on Work Permit or similar, then, in your case, you MAY apply during the 28 days prior to the 5th annivesary of your EC date.

Can I please ask another question:
I intend to leave the country for holidays and returning on 22nd feb 2013. This will mean I enter the country after the valid date but within the 60 months from the date of leave to enter. Do you think the immigration will allow my entry. I plan to apply ilr on 27th feb 2013 upon my return. Please advice. Many thanks

Regarding your 28 day calculation, I recommend you look under the "FAQs for ILR - WP/Tier 2/HSMP/Tier 1 - Read before posting" sticky post. It's very helpful and I found my answer there.
