Contradicting - Tier 2 General Extension query

Post by tier2applicant » Wed Jul 25, 2012 4:16 pm

I was granted Tier 2 General visa after April 2011, switched from PSW.

I was reading about extension and there seems to be contradiction information about need of Resident labour for extension.

1. The tier 2 policy guidance says. For same job role, employer no resident labour is required.Point198

http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

2. In the code of practice document. for few job roles say this "If you have previously sponsored a migrant using this job description under SOC 3131 and you wish to extend their employment in the same job a resident labour market test is not required."

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Not really sure if I have missed something here.

Question: Do I need to have a resident labour test while extending Tier 2 Visa for same job role and employer ?

I have the same question as above but I'm switching jobs and employer. Does my new employer need to conduct a Residential Labour Market Test?

Yes, its required; unless you are paid more than 153,500 or your job is on the shortage occupation list.
