When can I apply ILR

I am new here. I have a question to some one who could help.I find this forum is very helpful with real life experience.
I am currently in a unmarried spouse visa,
date of issue on the biometric card is 1 st sep 2010,
but next line, 'valid until' it says 27th Aug 2012.
However when I applied I was in Uk, and had proved 3 years of a relationship prior to aug 2010.
according to the rule that I should be completing 2 years in spouse visa I was given only 3/4 days less than 2 years.Am I correct. So can I still apply for ILR now or not.

You can apply no earlier than 28 days before the expiry date of the visa.
