Breakdown of Marriage - spouse on 2 year visa

Post by HTSB » Thu Jul 26, 2012 11:15 pm

I am a British citizen and I married my girlfriend earlier this year, who was a student here for 2 years. We were living together happily as a couple for two years before marriage, but sadly due to the stress of marriage and spouse visa applications, and the various financial aspects of all this, the relationship is breaking down.

We are considering a separation and possible annulment/divorce as we are both feeling unhappy in the marriage. I was wondering what her immigration status would be if this happened? Would she still keep her 2 year spouse visa? Would she be able to travel on this if we have annulled the marriage or will she be stopped at the border? Will either of us be able to remarry in the UK in the future?

Thanks for your help.

The essence of your experience shows how the immigration rules can force a fulfilling relationship into separation.

Rules/Laws are meant to help us make and keep relationships but here it is doing just the opposite. Its a shame to the system we have implemented.

All my well wishes to both of you and hope things get better for both of you.

Best of luck...

You were living together.
Then you got married.
Not very long after marriage, you are considering divorce.
As the same time as considering divorce, you are exploring the possibility of remarriage.

So, someones marriage is on the brink of total divorce, when both people are unhappy, and one or both are already exploring remarriage and trying to find out immigration implications already.

Wow. People could shout at me, but this seems a case of sham marriage.

Asim please try to keep your personal opinions/views on peoples relationships to yourself and and concentrate on replying to the OP's query. If you can not do that then don't assume things unless you have full details of ones personal circumstances
