Entering the UK with an expired shengen tourist visa

Post by VagabondLTX » Fri Jul 27, 2012 10:39 am

Hey there. I'm from Argentina. I've overstayed in Europe for more than one year.
Is it 'safe' to go from Spain To London with my expired visa? I'd go by plane.
My passport has not expired, what has expired is my permit to stay inside Shengen as a tourist.
Somebody told me there would be no problems since it's a flight from within Europe.
What's the worst thing that could happen?
Thank you for your time.

Your Schengen visa is not relevant to the UK as the UK is not part of Schengen. You would enter the UK as person who is not a visa national (and is therefore not required to apply for a visit visa, and can get entry clearance on arrival).

The only issue may be one of credibility. If the UK Border Force notices your overstay status in the Schengen Area, he may doubt that you intend to leave the UK within the period of your visit visa entitlement. You'll have to have some good quality answers to any questions that may be asked of you. If there is a UKBA local liaison officer at the airport in Spain, he may deny you boarding.

Actually - the worst that can happen is that the spanish authorities check your status on the way out and stop you there and then.

Almost happened to me on the way out of Germany where they thought my wife's schengen visa might be a fake.
