FLR or ILR?

I have some confusion for my visa apply so need your advice:

I have been lived with my fiancé in UK 3month during my business trip(business visitor visa) since Dec. 2009 -Mar. 2010, then we decided I apply fiancé visa when I back to china,
I got my fiance visa at Mar. 2010, I came back to uk by fiancé visa in Apr. 2010

I applied my finance visa extention at Sep. 2010,( because he got his Decree Absouted until Dec. 2011. )

but it's was been rejected at Nov. 2010.

then We appeal at Jan, 2011. I got my residence permit visa(FLR(O)) untill Aug. 2011

we married at 18th July(this month) 2012, my visa status is:


residence permit visa (FLR(O))
issued: Aug, 2011, expire date is Aug. 2014.

limited leave to remain.

no resource to public fund.

no work and no enaging to business.

register at once with police


so my question is:

if I can apply Indefinite leave to remain(ILR) as we are living together 28months so far in the UK, or I have to apply FLR(M) again?
