PSW to Tier 2

Post by mks09 » Sun Jul 29, 2012 7:49 pm

I am working for Pharma Company from 2010. I completed my studies in the UK (BEng, MEng in Biotechnology). I am on rolling contract in Graduate Program. After completion of Graduate Program (September 2012), my Department will decide if I'll be turned permanent or not. Though I have raised query with my line manager that my visa expires on October 2012 and I'll not have enough time for all the stuff which needs to be completed!!!. She said she is not even sure if I would be turned permanent, even though they require me more than anyone else! in the Graduates Team. I wanted to ask if they make their decision in October, how long it could take me to get Tier 2 General Visa!

Secondly, My Salary is £26000 (Base Salary) + £2000-£2500 (Bonus). I work as Clinical PK/PD Associate. Analyse, Model and Interpret Data from Clinical and Pre-Clinical Studies. Though my salary does crosses the prescribed limit mentioned on UKBA Guidance. I am not sure which category I am in! Biologists, Chemists, or What!!! Have no freaking idea!! Though I work in Lab (30%), Office (70%).

Thirdly my contract mentions I am on Local Level 7? When I asked HR what does that mean, She said she is not sure. I just asked I want to make sure if my job is at or above NQF level 6. She said they can't make any decisions till my line manager asks them to do so! wtf!!! Could anyone tell me even if I am eligible for Tier 2 General???

Share your experience if someone is in similar situation! I am too anxious now days

Quite funny I am asking this query evenn when I dont know If I would stay in this country or not  :( :x    :?

Assuming you have PSW leave at present it is a difficult situation. Your present visa expires in October and if your employer tells you in September that they are not making you permanent by sponsoring you under Tier 2 General then your have very little chance of finding another sponsor in the available time and will have to leave the UK. Why don't you start looking around now to see if there may be others willing to sponsor you?

As you know the minimum requirement for T2G jobs is NQF level 6. It is the employer (not you) who is responsible to UKBA for determining the SOC code for a particular job. There is a certain amount of flexibility here since there may be jobs which don't exactly match a description in SOC and employers have to choose the nearest best fit. You can check the SOC codes and salary requirements here:

(probably Section Q)

Print out from UKBA website all the information on Sponsorship and schedule an appointment with your boss to explain in detail how long is the process and that you can not wait till September for their decision. You can always mention that you might have no other choice but look for alternative options!

Hi Manci & Magelan

What you mean find another sponsor! As of I know Hardly Pharma Companies are willing to sponsor you until you have a PhD with 2-3 years work ex! To add to list Pharma is moving out of the UK My bad luck!!!
Let me know if you know other means!?!?

Anyhow I think Either I lie in Biologist/Biochemists or Other Scientific Researcher (Not Classified anywhere) I am above NQF Level 6. My HR verified that I am at NQF Level 7 (Masters Level, Though as per her Job is PhD Level So I should not worry about that). And Salary is ok too, though not as PhD people get in my company (£36000 + £4000-£6000 Bonus for the same job I do, but they invested 4 more years, Hope that would not be a problem).

My Company is too big/large to get my line manager sit with me and discuss my case. It has to go thru Operational Manager which further goes to Line Manager Admin Assistant and then my line manager. Line manager will further go to Company Manager who will further go to Global Head!!! This is just to recruit a person permanently! I hope things turn positive. Leaving UK after 6 years would be big Cultural Shock!!!!

Anxiety on Top, Can't even Sleep nowadays! My home country sucks in Biotechnology!!!!! and Pharma!!! Salaries are like SHIT! and TOO MUCH HARD WROK :x :? :(

You need to act now - go to your Operational Man explain how important this job is for you and how much you can contribute and make it clear that your time is very limited and you must know about your future with this company in the coming months, explain it is better for them as an Employer to speed the process now rathar than wait till September. Do your part and leave it with your Op Man to pass it though the line all the way to the Head. I think you need to be more pro-active!!! Best wishes!!!!
