ILR options and questions

Guys,

I have a couple of things to clarify and hope some of you may be able to contribute…..

Background – I came into the UK 27th Sept 2002 and got my WP in Jan 2008 – The current leave to remain expires in Jan 2013.

I become eligible to apply for ILR this Aug on completion of 10 years of legal residency and I also have another eligibility coming up in Dec following 5 years of WP completion.


1) The company I work for have sent in a Technical change of employment 4 weeks ago for an existing WP that I hold for change of work location to a new site–What is the normal lead time for this to be processed?

2) What are the things that I should consider / prepare (documentation / paper work?)to make an application in either of those 2 categories and what application forms should I use? ( My wife, has lived for 4 years in UK and 2 year old child born in the UK also live with me)

3) If my wife and I apply for ILR in January through post and hypothetically if it takes more than 3 weeks to process the application, the leave to remain for my child would have run out by then- Should I then apply for a visa for my child for the interim period?(under what category?)

4) And finally If I applied for ILR alone in Aug/ Sep this year on basis of long residency and given that this can only be a postal application, the same scenario from 3rd point comes into play – If it takes longer for the application to be processed, do I have to apply for my wife and child as a dependent of a work permit holder or another category??

5) Will the test of live in UK provide combined proof of my English language or is there an over and above requirement? (I noticed something along of the lines of “accredited College” –Is there a list available to verify if the college that I graduated in is listed here?

Apologies, if some of these are basic questions but I was going to assess the options available to me and pursue the best one!
