Do I qualify for ILR

Post by Renni » Mon Jul 30, 2012 7:47 pm

hello all, I have a very complicated story and was wondering if I would ever get ILR or infact any visa in the UK. I will try to make this as simple as possible, but would greatly appreciate if I can get some support / advice for this forum. (Please note I am using my girlfriend's account here).

Right so I arrived in the UK in June 2002 and immediately seek asylum. It was granted for 2 years. After that I am on this battlefield of getting a visa via numerous solicitors (who I have all paid large amount of money) and still currently have not yet got it sorted.
On 2 occasions I have got refused and then I appealed once (advised by my solicitor) and it also failed. In December 2010, my solicitor again decide to submit a legacy application...and in March 2012 I received a letter from the HO requesting for 2 passport size photos and some pay slips if I have any. Up to this current date I still have not received another word from the HO. After speaking with my solicitor and he keep on telling me to wait...I turned to another solicitor who told me that it does not look very good for me, because the first solicitor submit the incorrect application :(

Now I have been in this country for 10 years and have a girlfriend (not UK citizen) for 7 years who is currently a student. We are engaged for 6 years now. She is due to apply for her 10 year ILR in December 2014.

Given that my solicitors say that I have very slim chances of getting my visa, is there any other route anyone can suggest me?
- What if I marry my girlfriend and become a dependent on her visa - is this possible (taking into considerations the above story)?
- What if we have a child together - would this make my chance any better?

Note: I am not only saying to have a child for visa purpose. We have long wanted a child together, but we are afraid of the visa issue. I don't want to leave her alone with a baby and i can't be there for them both when they need me.

I would appreciate any advice / suggestions (based on either your own experience or logical solutions).

THANK YOU ALL VERY MUCH!
