TIER 2 - EMPLOYER LETTER CONFIRMATION

Hi All,

This forum has been invaluable to me in my quest for ILR.

I'm currently on Tier-2 ICT and am eligible for ILR soon however I have a concern with the standard letter my employer provides. Please let me know if this is ok.

TO WHOM IT MAY CONCERN

This is to Certify that ##### is a employee of XYZ company

He is currently deputed to the UK, working as [b][i]Actual Designation [/i][/b]for abc client in Manchester. He is here on a Tier 2 visa (SOC Code 1234) and is expected t o continue in the UK for [b][i]at least the next 12 months[/i][/b]. His date of joining XYZ is xx/xx/xxxx. His date of arrival into UK is ##/##/####

We confirm that his gross annual salary is [b]£##### [/b]

My Key questions are these:

1) My actual designation is different from the one in my SOC code. Does it matter?
2) It does not explicitly say I'll be here for the foreseeable future but says I'll be here for at least 12 months. Is that fine?
3) My gross salary is almost double the minimum rate as required by the SOC but does not say "that he is paid at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors published by the UK Border Agency"

Please help me with these queries

Hi

First of all you can use the link from the previous there's a quite good format available of the employers letter for the Tier 2 and WP holders applicant who are applying for their ILR.

1) It doesn't really matter just ask your employer to mention this that this is the closet match of SOC code for Mr.XYZ Then it should be fine.
2)If your employer didn't mentioned this explicitly that you are required for the forseable future than I am affraid your employer letter will not be accepted by the UKBA as this is mandatory to mention this line explicitly in your employer letter and the CW are trained to see if this line is mentioned with these wordings in the employer letter or not.
3)Again your employer has to mention this explicitly that your salary is above the rate as compared to the Salary mentioned in your SOC code other wise the CW might object on that regardless if your salary is tripple the amount of the salary mentioned in your SOC code.
