Need help urgently-PSW to Tier2-Can i work after PSW expires

Hi Everyone,

My name is Raj. I'm in PSW visa working as a Web developer and visa expiring by 2/08/2012. My company is ready to sponsor me, but they have to register as a sponsor. I'll be applying for sponsorship today(01/08/12).

1. Could you please tell me how long does it take as this is the first time they are applying? First i have to apply for sponsorship, then only i can apply for my Tier 2 visa after getting reference number.

2. As my visa is expiring by tomorrow(2/8/12), i'm applying for Tier 4 as well, as i have to be here when i'm applying for my Tier 2 or in case anything goes wrong? So now my employer is asking whether i can work after my PSW expires when you applied for your Tier 4 or you have any UKBA documents to prove it?

getting a sponsor licence currently takes 3/4 months

If you swtich to tier 4 you wont be able to switch to tier 2 under PSW. Then the only way would be to go through resident labour test. if you swtich to tier 4 , you wont be able to work for your company for more than 20 hours per week.

I personally believe u need a immigration advisor for your situation

1. Actually i want to take a chance by applying as Tier 4 so that i can stay here. In case i get and if i have to work 20 hours i'm or my company is ready for it. But i'm applying for sponsorship then Tier 2 as well. If i get Tier 2, i'll withdraw Tier 4 as it will take 3/4 months. But my question is can i work now (as PSW visa expiring by tomorrow-02/08/12) when i applied for Tier 2 or Tier 4 as my employer is asking for UKBA proof?

(1)u wont be able to work after your visa expiry unless u have an outstanding application with UKBA.
(2) yes
(3) resident labour if you swtich from tier 4 to tier 2. For PSW no resident labour test is required.

if i were in your situation i would have made the licence application today and tier 2 visa application tomorrow without the COS number , requesting home office to hold on the application till any decision can be made on your employer licence application and you get your COS allocated. In this way you would be able to work full time for your employer.
But there is a risk in it. If UKBA refuses to hold your application then you have to go back to your home country. if you want to go this way , you should hire a solicitor. Or you can apply for tier 4 considering the restriction.
