Hi Everyone,

My name is Raj. I'm in PSW visa working as a Web developer and visa expiring by 2/08/2012. My company is ready to sponsor me, but they have to register as a sponsor. I'll be applying for sponsorship today(01/08/12).

1. As my visa is expiring by tomorrow(2/8/12), i'm applying for Tier 4 as my Tier 2 sponsorship will take time. Now my employer is asking whether i can work after my PSW expires when i'm waiting for my Tier 4 or you have any UKBA documents to prove it? He said not to come for work until i show letter from UKBA that i can work.

When you are going to apply for Tier-4? Visa is expiring tomorrow and you still applying. You should have been applied by now!

If you will not apply by tomorrow with an HEI sponsor/working hours permitted course, you cannot work anymore in UK until application decided. So your employer is doing right.

If you make a valid in time application to switch to tier 4 you will be subject to the conditions of your psw leave until your tier 4 application has been decided. However you will be unable to switch from tier 4 to tier 2 unless you obtain a UK recognised degree or complete one year of a PhD during your tier 4 leave. Instead you would need to apply for tier 2 from outside the UK using a restricted cos and your employer would need to undertake the RLMT unless your job is on the shortage occupation list.
