need your expert advice and review for my case below:
HSMP VISA stamped on my Indian passport on Nov 2007 ( valid for 2 years)
Later HSMP/Tier 1 Visa extended for Next 3 years ( From Nov 2009 to Oct 2012)
As per visa I m completing my 5 years of HSMP/TIER1 visa stay by OCT 2012 and Hope to qualify for ILR.
Problem with my case:
I was not aware about 90 days out of country stay at one time?
So I went to India in Feb 2008 and Back to London June 2008 nearly Out of country 110 days in one continuous stay ( this stay was not related with any work, went for holidays and was ill so wait until my medical treatment was finished)
Later due to rescission I was not in continuous Job and been visiting to back home quite frequently for different reasons..
Like My Marriage, then medical treatment, death in my family.. so on going family Issues and so far my out of country stay
all together is nearly 350 days since nov 2007.
Out of above stays one continuous long period stay was 110 days ( Feb 2008 to June 2008)
could you please guide me how to sort my visa issues?

I was at the HO on 31st and saw an applicant who had 97 days out of the country. Even though he was paying his rent and council tax for the said time, but not employed, and was out of the country, the lady on the ground floor in Croydon who screens applications said quite clearly that this would be refused, and he should wait for 5 years starting from the time of his re-entry.
He had applied through a rep and this was the reply even after the rep asking about discretion.
So it just seems a bit difficult. Sorry don't mean to dishearten you, but thought its worth sharing a first hand experience. Best of luck.

Thnx for your feedback and update... guess in My case, my 5 yrs ll be counted from June 2008 ( since re enter after 90 days)

Even with a rep is this response. You have to prepared strong evidence for >90 days absence. If you were unemployed and went to your home country CW thinks you are not serious to make UK homeland etc. Its all depends on CW discretion / mood . But they are very strict on absences these days. So better to consult any good solicitor that the best choice for you.

TThnx for your feedback... I read some where, higher absences case are only handle by HEO and not normal CW or SEO.... so I m bit worried?
