ILR - 10 Year (Dependent's settlement)

Hello,

I have been reading on this forum for long time. I have following question, would be very grateful if someone helps.

My 10 yrs would be completed in Sep 12 (i-e I can apply for indefinite visa in Sep 12).

Currently Iam on workpermit and would be completing 05 yrs in Nov 2013.

My wife came as a dependent on my workpermit visa in Mar 2011.

1 -If I apply for indefinite in Sep 12 based on long residence , would my wife need to fill FLR(M) and again apply for settlement in Mar 2012 by filing SET(M) OR she would need to wait for 02 years OR 05 years once she gets FLR(M) based on my indifinte i-e 10 years. (02 yrs ? or 05 yrs ? )

OR

2 - Would she be able to fill directly SET (M) in March 2012.

Please plz advise and many thanks in advance.

Correction - Year Mar 2013 NOT 2012

1) ..again apply for settlement in Mar 2013 (Not 2012)

I understand, if you are not a PBS visa holder, and she has not completed 2 years yet, your dependant will have to use FLR(M) form first. When her 2 years comlete, she can switch to ILR. You also need to read this;

This should explain if your partner needs to wait for 2 years, or 5 years. To me it looks like she does not need to wait for 5 years as she has had her dependant visa before the 9 July 2012.
