Help with spouse visa please!

Post by Rebeccaty » Sun Aug 05, 2012 9:48 am

I am hoping for some advice.

My husband has been in the UK for 4 years on a student visa followed by 2 years on a post study work visa. He has still not found employment in his study field (engineering) but is doing retail work (minimum wage), whilst seeking employment with his qualification (masters degree). If it is relevant, he is American.

We have been married legally in the UK and living together (we obtained a marriage visa and married in this country) for 4 years and he has been living legally in the country for 6 years and never outstayed. I am a British citizen.

His visa expires in 6 weeks. Is the correct visa to get now FLR(M)?

We do not meet the minimum requirement for funds that has changed since July, but I am in receipt of Disability Living Allowance (for the last 10 years). I also receive working tax credit (which is listed in both our names as we are married) which I very much hope is still permitted (can anyone confirm?) and not be "recourse to public funds". I am self employed and he works in the store that I own.

I cannot find a list of what documention we need to provide and I am very confused by what we need to send as supporting evidence and how much "maintenance funds" we are supposed to be providing, and it could get complicated due to myself being self employed and him being employed by me but we have bank statements, wage slips for him, my personal and business bank statements and business tenancy agreement, plenty of evidence to show my store exists but do I need to go into detail like my self employed tax statements?

What happened to "Life in the UK" also, we were told he had to get this certificate before but now I can't find any mention of it. Should I just send it in anyway?

We are hoping to do this in person, does our case sound likely or with maintenance funds does this make it too complicated?

Much appreciated for any time anyone can give me.
