Spouse salary less than 18k

Hi there,

I am getting married to a person in the UK who has got an Indefinite Leave to Remain (ILR), the problem is that her salary is less than the newly established threshold of 18k a year, her salary is roughly 16,800. Is there a way to apply for a spouse visa if I can prove that I have enough funds that can last me for two years without having to need any help from her (say if I can show 50k available as maintenance funds in my personal account) and if I can prove that I have qualifications that enables me to find a job in the UK?

A job offer is no good - but the savings can be used.

The amount will need to be your account for a period of 6 months prior to the application.

The equation you need is 16k + (income shortfall * 2.5) so in your case - that works out to £20,500.

The 16k is her salary actually not mine, I don't have a job offer yet. So the situation is as follows:

- I have savings equal to 50k
- Her salary is 16,800

Can I still apply as her spouse? Will be great if you can send me the link to the particular section of the immigration guide that applies to my case.

On those figures - yes you can - and I did get that it was her income.

As in the rules - you'll need to show that your £50k of savings have been in the account for 6 months - and assuming you fail to get a job in the UK need to show it again at the 2.5 year marker.

do they accept any savings that you have in past 12 months? or lets say i have 7k in my account and my parents to give me another 10k & write a letter to say that its a gift? and if i join my savings with my partner do they accept it?

As per your other thread-you would require 30k in savings. 17k would not be sufficient regardless of where the money comes from.

thanks..fair enough its 30k. but surely if you add extra 20k in one or two transaction they gonna for some proof where I got the money from, or it doesn't matter as long as the savings are there for next 6months or so?

I've made the assumption up to now that the 6 month rule is to get around the idea of 'short term cash gifts'.

I.e. the fact someone has to have it for 6 months means a relative can't just loan it just prior to the application as they could previously.

So I've assumed that no proof of the gift would be required as it'd be yours and in your account for that length of time.

But then, a letter confirming it (dated 6 months earlier) might not go amiss.

thanks, my wife recently received the certificiate that she passed the english test,and just wondering how long does that last for?

Information required regarding spouse visa & Savings

I have completed my graduation here in Pakistan and doing full time job as Mobile application developer. we have plans to get married in feb 2013.

I also wants to do masters after wedding from UK.

As the new immigration rules are applicable after 9th, july 2012

What are the possibilities of getting spouse visa,

if i get student visa for masters and then after completing my master i get job in uk ( more then 18,600 pounds )
and then apply for spouse visa showing uk job letter to UKBA (Although we get married in pak in feb 2013)

OR if take the saving options, how much amount we need to show to get the spouse visa.(my spouse is doing part time job from last 5 months nn earns 700 pounds per month)

My father has his savings on his name as national savings certificates, can i show that after getting authority letter from him and putting that money in my account in pakistan or i should i have to send the money to spouse's bank account in UK? Will it be ok if i keep money here in my bank account for 6 months and then we both show our bank statements when we apply in march 2013 hopefully?

Me with my family applied for Uk visit visa in 2007 but was rejected unfortunately due to lack of fund in bank statement and financially.

After all this information what is the chance of getting the spouse visa?

Is there's any way out or solution that can be done?

My spouse is my mother's sister's daughter. We both want to get married, but this rule has stressed us alot :(
