Planning ahead - ILR timeframe

Post by veejay » Tue Aug 07, 2012 3:48 pm

Ladies/Gents

I believe I have a reasonably straight forward question. Please see the details and question below

Type of Visa - Work Permit
Work Permit time frame - June 1, 2008 to June 1 2013 (5 years). I have not switched to Tier-2 since I never had/have the need
Type of work - Salaried
Salary - Base of £70k plus 10% to 15% bonus
Education - Masters degree

Additional notes
  • Continuously employed with salary etc. going in monthly without exception
Never in violation of immigration rules
Clean record with no violation such as traffic tickets etc.
QUESTION
- My Visa expires on June 1st, 2013
- I understand that I can apply for my ILR, at the earliest, only by May 3rd 2013
- I see that ILR applications are taking a lot of time - sometimes a good 4 months
- What happens if my application gets rejected for any reason (say clerical error) in, say, July 2013? Will I be treated as someone who has over stayed his visa limits?
- Also, how much time will I get to wind up and leave UK in this scenario?

It is purely hypothetical, but just wanted to understand the impact. My company has offered to extend my visa beyond June 2013 - so just wanted to check whether that would be a better option.

Thanks a lot for your time and inputs

regards

I am on a Tier-2 visa (then called WorkPermit), issued for 5 years, and came to UK in Jan 2009. I have my visa valid until Jan 2014. At that time, my wife and daughter also came with me, and they also have a dependent visa stamped until Jan 2014.

You have different leave validity dates.

Which one do you want to go by?
Please do not send me PM if I haven't sent you one yet.

Hee hee - both are not the real dates. I am a bit security/privacy conscious and never give out the actual dates. The real date is between June 2008 - Jan 2009 !!

For the record, let us just go with June 2008 to June 2013
