Fiancée Visa on Disabled living allowance

Post by Windwhisper » Tue Aug 07, 2012 10:40 pm

Hello to all I am on Disabled living allowance and this is exempt from the new income £18.600 requirements.

But the problem is from what I know is as I am not on Maximum DLA I don,t reach the £150 support level that I believe is still needed I have accommodation I have regular income as DLA but how can I reach the needed level to be able to get my Fiancée Visa ??? what options do I have?

Its driving me crazy as DLA is Exempt from the new income level but still it seems I am stuck between what I need and what I get?

Any help would be much thanked

I too am trying to find out if DIsability Living Allowance has to be a certain level of DLA to recieve in order to qualify for not having to meet the Financial requirements. There are 3 different levels I think of DLA

Care component
  • [li]Highest rate
    Middle rate
    Lowest rate [/li]
    [li][/li]
Mobility component
Higher rate
Lower rate

If anyone knows that would be helpful!

Newlight, you've applied under the old (pre 9th July) rules haven't you? So this won't be relevant in your case. :?

What is your total weekly income from benefits/employment etc- can you break it down eg, DLA, ESA etc. How much is your rent/mortgage and council tax each month?

Casa, yes we applied under the old rules  For my Maintenance in the application I as the sponsor have £3914.56 in a Current account
£3915.61 in Cash ISA
£1,257 Fiance has in her current account
I receive 105 per week Contribution based ESA
We will live with my parents, no rent to pay.

I just knew a couple of people who were receiving DLA and they wanted to know if the DLA had to be a certain level to be exempt from the financial requirement and they were trying to find out, so just trying to help them out really and find out for them.

I am trying to find out for a Disabled person, who can not use a PC very well and he would like to know if Disability Living Allowance can be counted towards meeting he maintenance requirement in a new application ie an Application for a Fiancée or Spouse Visa for instance that is made now? I know it could before the July 9th changes but can it still be? Thats what I cant quite understand?

Yes it can. Would suggest that you refrain from trying to advise this person and that he instead seeks legal advice from a qualified professional.

OK grennie, I will thanks. Hes is having trouble finding a legal aid solictor at the moment.

Also do you have to have been awarded DLA for a certain length of time do you know? Like DLA must be awarded for at least 1 year or something?
