Post by Ket » Wed Aug 08, 2012 8:28 pm

Hi,

I won my article 8 appeal in January 2012 and still waiting for visas to be processed. I would like to know if i will have to enrol for Biometric Resident Permit?

Thanks.

You have the patience of a saint .If you don't chase your papers you will wait forever.

You will have to enroll for biometrics when UKBA send you a letter.

Don't phone the 0870 number.......they are just a call centre.....phone your local enforcement team where your passport is likely being held.

I posted lots of local ukba numbers here http://immigrationboards.com/viewtopic.php?t=86090 look for the center near your home and give them a call and if possible fax them the judges ruling.

If you don't get any progress within a week i suggest get hold of your mp and ask him or her to help.I think you have waited to long.Tell him or her how long you have been waiting and ask him/her to find out why you have not been issued with your papers.

Thanks pepekalle. You are a star. Any further advise will be appreciated.
Would you be knowing whether new or old rules for discretionary leave will be applicable to me as you know my appeal was in January and still waiting for visas to be processed. I hear new rules were in force on 9th July 2012.

It would be helpful if you indicated which rule you are concerned about as they introduced so many new rules.

A few people have been saying that new rules for article 8 human rights were introduced on July 9th 2012. I would like to know what these new rules are and will these new or old rules before 9th july be applicable to me.

Hi guys, just wanted to give my advice. You really do have the patience of a saint. You need to get your mp involved they will write a letter to the home office and give you a time limit of 2months for a reply. They can chase the enquiries up, and seem to get more details than you can.
We won our appeal on the 8th may this year went to see the mp on the 9th july and received a response from the home office dated the 1st aug, they also issued in a seperate letter a liable to be detained notice, which apparently was an administrative error, and assured our solicitor that his leave to remain has been issued and should we not receive it in 10 days to contact them. The home office have said that we wouldn't be subject to the new rules, does this mean he will not need a brp?

Thanks in advance
:)
