Apply before current leave expires or wait for COS

Post by deviljin_svs » Wed Aug 08, 2012 8:57 pm

Hi,

I'm currently on a PSW visa which expires on 9th August 2012! My employer applied for the Tier 2 sponsorship license in June 2012 and requested for an urgent processing on 24th of July. On 6th of August, UKBA replied:
"We can confirm the application is being treated as urgent".

Today is the 8th and we still haven't got anything from UKBA!!!

What do you ppl advise me to do?

1. Apply on the 9th August without the cos and employer license number? If yes, how should i proceed with it?
2. Wait until the employer gets the license and then apply? I'll be considered as an overstayer, right?

Note: my employer called the immigration ppl at UKBA and they advised that i hold my application until the COS is given. But i'm not convinced with their answer!

Regards

Vikram.

I'm no expert but I would say apply before visa expires rather than waiting for COS. Then you can submit the COS details as additional evidence. You would need a cover letter from emplyer explaining the situation and requesting processing delay.
I was in your situation a few weeks ago and that's the advice I was given on this forum. Fortunately for me, the COS came thru just in time.
Al the best and God bless

I have just read your thread. Could I ask you if you have made a Tier 2(General) application without the CoS now?

My employer has made a sponsor's application sometime in April which seems like ages ago and is still awaiting.

Thanks,
S
