Application for spouse visa, need help please

Post by hallian » Thu Aug 09, 2012 12:34 am

Hi everyone.
I need to ask this question about the new immigration rules which came into effect from 9th of july 2011. I got my ILR in November 2011( 9 years as student and one year tier1 PSW. My wife is in this country since 2005 to 2010 as my dependent on student visa and from sep 2010 onwards on my dependent( tier 1 psw). I applied last year 2011 ilr which i was granted. After this i applied for naturalisation of my two daughter and their british passports which was granted aswell. In this process my mrs application was delayed uptil now aug 2012. She is still on my old psw visa.
My question is that what is the best and short way for me to proceed. do the old rules still apply to my Mrs application.
Can i apply direct for her ILR or she has to go for FLR(M) first, as she will be completing 2year on tier 1 dependent visa which she got extention on as my dependent though my status changed to ILR.
do we have to show the finances of 18600 or she is ok and can apply in transitional arrangement.
does she have to show english language certificate fresh when she already did edexel level 3 two and half years ago or life in uk test she has to do.
please help with your replies.
Thank You

Life in the UK test is required, so she will need to pass that, the English language requirement is not there in the old rules for ILR as Long as she has Life in the UK certificate.

I think she will need to get FLR and then ILR if she has already done 2 years.

Although I may be wrong in the above statement in terms of FLR -> ILR. Maybe ILR directly is allowed. Hopefully someone can confirm.
