Tier 4 dependent child refusal help

Post by mflores » Fri Aug 10, 2012 7:21 pm

I was granted a Tier 4 student visa but my 11 yr. old son has been denied. His father and I never married and separated over 3 years ago but I have his father's permission to take him to the UK for the duration of my studies. However I did not submit a consent letter with the initial application as I was not aware that I would need one. Do I appeal the decision or can I ammend the original application or should I submit a new application? What type of documentation must I provide to prove that I have his father's consent to take him with me?

It's not about having the father's consent. It's about you having sole responsibility for the child. Clearly if you need the consent of the father you don't have sole responsibility. In theory, a statement from the father declaring that you have sole responsibility (rather than ceding his permission) would suffice, but it may be better to seek advice from a family lawyer for more appropriate documentation. Do you have custody order from the courts?
