Tier 2 ICT- Any Possibilities For ILR?

Post by dr_shiva29 » Sat Aug 11, 2012 8:39 am

Hi All,

I have been working as a Project Manager in my current company subsidary in India for 4 years when management decides to transfer me to the UK subsidary in 2011. Got my long term Tier 2 ICT visa in Sep 2011 and due to some obligations at work could not move to the UK until Dec 2011.

While applying for the visa my company HR mentioned that I will be able to apply for ILR, however, after researching through the internet, it seems there is no option for me to apply for ILR even after I complete 5 years in the UK.

Can someone advise if there is any possible way for me to apply for an ILR by switiching to any other visa categories or any other option?

Further search led me to the following site http://www.hsmphelphere.com/switching-f ... eneral.php where it is mentioned that one can move from tier 2 ICT to tier 1 general. I have written to them but have received no response.

Any thoughts? If there is no way for an ILR, I will have to think carefully about returning to India as I would not want to miss opportunities currently available for a temporary stint in the UK :(

As a T2 ICT migrant you would need to have had leave under the rules before 6 April 2010 to be eligible for ILR, which you didn't have.
The current policy guidance for T1 (General) is here:
http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf
you will see that switching from T2 ICT is not allowed .
