Hi,
I would like to seek your informed opinion/expert knowledge about the following and apologize in advance if this is the wrong forum.

I myself am a British Citizen and the query is about the stay of my Mother who holds a 10 year multiple entry visit visa (category C) due to expire in 2014.

This week, on Wednesday (8th August), we both entrered the UK together after returning from Los Angeles. This is post her entry here on 5th May 2012 and subsequent departure to Los Angeles on 11th May 2012.

When she returned to London with me, she stated her stay duration (as per her booked return flight) was apprixomately 3 weeks.

However, due to a change in circumstances back home, the query is as follows:

Will the entry on 8th August be considered a new entry and can she thus stay 180 days as per her visa conditions?

Everytime she is admitted, if she is admitted, she can stay for the full 6 months and this irrespective of her previous entries; she will not be classed an overstay as she has been given a new period of six months on entry. It's the job of the immigration officer to determine her suitability for entry and if, ever, he considers she is stepping outside the guidelines for visit entry he may choose to curtail her leave or refuse her entry. However, it's fair to say that at some point she is likely to be challenged about the volume of her days visiting the UK and at some point she may be refused if she is abusing the rules.

For example, a person could stay in the UK for six months, then travel to France for a few days, then return to the UK, but only to catch a return flight to their home country that is leaving from Heathrow. The new entry would permit that person to stay for a full six months because the entry was granted and is therefore entitled to stay for that time. But, next time that person tries the enter the UK, if it's soon after, the IO may consider that the total time in the UK has already gone beyond the accepted limits and refuse entry or reduce the period of entry accordingly.
