Help about Tier1 visa Unused Period extension

Post by sumantht2020 » Sun Aug 12, 2012 1:25 pm

Hi,

I got Tier 1 visa in November 2009 from India. After that I have not traveled to UK. I have not used the Tier1 visa from Day 1. It is valid till November 2012. I know its very late, but is there any chance that I can reapply the same Tier1 visa for the unused period like a new one or like an extension ?

Please help me...

Regards
Sumanth

Your visa is still valid for entry into the UK to pursue activities related to that category of leave. You would then need to make an extension of that leave if you wished to remain further, beyond the expiry date in November. An extension would require you to score sufficient points to qualify.

I don't understand what you mean by getting a visa for the unused period? What are you trying to say? You already have a visa and it will expire in November. You can use that visa until November. Whether you score points for an extension after November depends entirely your previous salary in India, something which only you can know, so there is no chance of comment on that from others.

Tier 1 (gen) is now closed to new visa applications but continues to permit extensions made from inside the UK. This will continue (thru a process of natural wastage) until all Tier 1 (gen) holders have left the UK or switched into another immigration category. Theoretically a Tier 1 (gen) immigrant can remain on that status indefinitely (thru regular extensions) if they continue to score relevant points.

Unused period

Post by sumantht2020 » Sun Aug 12, 2012 1:56 pm

Hi,

As I have not entered to UK from the November 2009, I have not yet used the Visa till date. Like in US H1b, there is a chance that you can use those days when you stayed outside the country, is there any chance that I can use the last 2.5 years which I have not used.

No, the visa period began to be consumed from the date of issue. You can't recuperate the time that you did not use while remaining in India.
