applying for tier 4 visa clarifications

Hi All,

I am helping my family member to apply for tier 4 student in order to study English and then apply for university.
I have some questions as below and appreciate all answers:

1. What is counted as higher education,is it only universities that offer course above NQF 6 or also English course providers who are on the tier4
sponsor list.

2. This question relates to above, is she allowed to work? In the guidance it says” they are allowed to work 10 hours per week if studying in a higher education or 20 hours if studying degree and full time during vacation”

3. In regard to meeting the English requirements, I am slightly confused. He is commming here to study English thus why does he have to proof her language competence?
here is a quote from UKBA website

“f your CAS was assigned to you on or after 21 April 2011, your education provider must ensure that:
• you are competent in English language at a minimum of CEFR level B2, if you will be enrolling on a course at NQF 6/QCF 6/SCQF 9 or above (unless you are a gifted student studying at a higher education institution - see below); or
• you are competent in English language at a minimum of CEFR level B1, if you will be enrolling on a course at NQF 3-5/QCF 3-5/SCQF 6-8; or
• you are a national of a majority English-speaking country (see below).
If you do not meet the English language requirement, your education provider cannot assign a CAS to you.


4. on UKBA website it mentions that he will need to show proof of 9 month of living cost ( 800 per month if outer London otherwise 1000 p/m). this money has to be in his account for 28 days. What about if I agree to pay all of his living costs while in the UK , I am a full time employee on tier 2 general with salary of 26+.
Will this be acceptable? He is my brother

5. On UKBA website it is mentioned that he will need to send all documents sent with his application to the education provider to obtain cos, she only sent her passport and no other qualifications , is that acceptable.

1. A higher education institution is a recognised body with degree awarding powers-essentially a university -so no not all education providers on the list of sponsors come under this category.

2. That's not what the guidance says but in answer to your question-if she is studying an English language course, she will be able to work 10 hours per week if she is studying at an hei or a publicly funded further education college. If she is studying at private college she won't be able to work.

3. Tier 4 is not for migrants who have no English-they can only studying English from a certain level. If she is not proficient in English at level b1 then she can't come to study under tier 4.

5. The sponsor will list qualifications used to obtain the offer which should include evidence of her English language ability.

thanks for your reply.

when i came here my english was very basic in 2005 and did apply to study in an english college, has that rule gone and he can no longer come here to complete his english then study in the university?

in regard to working, what do you mean by hie

i think his english is ok and may be able to get IELTS 4 , is that equivelent to B1 or B2? which could then allow he to continue his english and obtain a degree?

The rules have changed. If he wants to study English at a basic level he would need to come as a student visitor.

An HEI is a higher education institution.

Ielts scores of 4.0 in each component are equivalent to b1

I guess he will have to apply for tier 4 visitor after reading the guidelines on the UK following your suggestion.

I have few questions on the visitor visa and think it is appropriate to open a new thread for it
