CoS - Transitional Arrangement A

Hi there,

we are trying to assign a CoS for an employee for the second time (first time it was granted, but under complicated circumstances, including a court case - where our appeal was granted). The trouble is, we don't know what to put for the job code and salary.

We are a charity, and as such, pay less than the minimum amount; however, leave was previously granted, based on the fact that the employee already held a work permit with us, before the point-based system came into place. We don't want to put an inaccurate code (which demands a certain salary) in case they deny the visa application straight way, but there is no way to indicate that we are applying under Transitional Arrangement A.

We are planning on putting a cover letter, with copies of the judge's ruling from last time we appealed (for the same reason i.e. we don't pay any of our workers the minimum amount specified by the UKBA, as we can't afford to), but would rather sort it out beforehand, in case they simply turn us down straight way.

Has anybody else had this problem? Does anyone have any advice of what we should do?

one would need to see the ruling in the appeal case (presumably first tier tribunal) before being able to comment.

According to current rules the job would have to be at NQF6 level and the salary must be £20k or the minimum prescribed for the appropriate SOC code, whichever the higher. Details of SOC codes and salaries are here:
