student visa/residential qualifying period

Post by RatMonkey » Thu Aug 16, 2012 2:15 pm

Hello I have just obtained ILR and have a quick question. I spent 2 years on unmarried partner visa and 2 years before that on a student visa. I know I need to hold ILR for one year before applying for citizenship.
Does the 2 years spent on the student visa counts towards the residential qualifying period?

Thank you for your time.

Yes. However, if you are not married to a British citizen (unmarried partner is, clearly, not married), you have to make five years of residence and have been free from immigration control for at least 12 months.

Ah so next year August I will have 2 years student visa plus 2 years unmarried partner plus 1 year on ILR. That means I then have the 5 years and could apply? Thanks

I entered in the UK in 2007 as a student, married with a British Citizen in 2010. Spouse visa was granted & now BRP card is issued on 14-08-2012.
I have been living in the UK for the last 5 years (i.e. from 2007).
Let me advise Please:
1. Does the 3 years spent on the student visa counts towards the residential qualifying period?
2. What the LAW says i.e. Can I apply straightaway for the UK naturalization?

Malik39: when you say "Let me advise Please:" do you mean you need advice on these questions ?

Normally "Let me advise Please:" means you want to give your advice on something. Please can you clarify ?
