RIGHT TIME FOR ILR???

Hi all. I have been observing this forum for a loooong time and I can say its the best there is on the net. Very informative. I meed your help guys and advise as to what to do. Here is my situation
Came in as a student in sept 2005. Got my HSMP sept 9th 2007, applied for Tier 1 in August 2009(due date sept 8th 2009)
Was refused due to insufficient evidence of pay, went to court on appeal and was eventually granted in february 2010.

Now my question is am I eligible to apply for my ILR now since I have acually spent 5 years come Sept 8th this year am I meant to wait till february 2013 when my present leave expires. Pleaseeeeee I need your help fast before I go insane.

Has anyone been in this situation as I want to apply in septmeber through PEO. Thnaks for your help

Yes, so long as your 5 year residence has been lawful and you have not spent over the 180 day threshold outside of the UK (with no single absence over 90 days) you will be eligible to apply 28 days before the 5th anniversary. Did you enter the UK on your HSMP visa or switch immigration categories in-country?

Aah, thank you for replying. I was getting frustrated. I entered in 2005 sept as a student then switched to hsmp sept 2007. Have only spent a total of 90days outside in 5 years of about 5 exits on holidays. My 12months salary is also above the maximum given but am just thinking that because I was initially refused tier 1, they might act funny even though I won the case on presentation of the requested evidence. Thanks

And also remember to carry with you ALL the paperwork from your earlier refusal/appeal/grant. If and when needed, the papers will do all the talking for you.
