ILR 5yr residency and one day service

I have a confusion regarding one day premium service for my case. One solicitors says I can't go for one day because my residency of UK hasn't completed 5 years, other solicitors says there is a allowance for 3 months, so I can go.
I am writing this post to get advice from concerned HSMP members. so that I could make right decision.

My details are as follows:

Date of entry clearance as HSMP : 17-09-2007 to 17-09-2009
Date of arrival at UK : 2nd Dec 2007
Visa extension  :05-10-2009 to  05-10-2012
Holiday spent : 30 days in total, in whole stay

Financial activity : Employed + self employed

Does I full fill the 5yr residency criteria to applied for ILR through one day premium service? Or better through postal service.

Looking forward for your suggestion and advice.

Extension in Tier 1 4/12/09 for three years
Abscences about 8 weeks altogether on 4 different occasions

Am I eligible for ILR?
Can someone help with this please
