ILR and Naturalisation Information

Post by Maqsood ahmad » Sun Aug 19, 2012 3:28 am

Hi I am currently in UK on Tier 1 General. My first HSMP leave was from 30 Aug 2007 until 30 Aug 2009 and extenstion as Tier 1 General from 7 Oct 2009 until 7 Oct 2012. Before HSMP, I was already in UK on a study visa from Oct 2004 until I got my first HSMP visa on 30 Aug 2007. As my 5 years complete on 30 Aug 2012, am I correct in believing that I am eligible to apply for ILR 28 days before 30 Aug 2012 even when applying in person?
Also my wife and 1 year old son are in UK too as my dependants.
My wife arrived in UK on 02 Oct 2010 so she is eligible to apply 28 days before 02 Oct 2012 - Is that correct?
My son was born in UK on 03 Aug 2011. What do I do about his immigration. Should I apply for ILR for all 3 family members at the same time in 1 application when my wife's qualification period completes i.e. 28 days before 02 Oct 2012? Please note all of us have got Tier 1 General (myself) or Dependant of Tier 1 (wife and son) until 7 Oct 2012. I am also under the impression that my son can be naturalised as British citizen as soon as I get my ILR? Problem is we must go aboard in december to attend a wedding so dont want to risk our passports / travel docs out of our hands holding us here? By the way I have got an appointment booked for 3 of us in Public Enquiry office on 20th Sep 2012. Ideally I would like mine and wife's ILR and child's natuaralisation completed when applying in person on 20th. Is that possible? Can any mate please advise best way to go about it? Kind Regards. Maqsood

You child will not apply for naturalisation.

Your child will be registered as British citizen, once you get ILR. You do this by filling up form MN(1).

There is no same day service for any nationality applications. The only way is either to apply by post, or through NCS.

If you are planning to travel in december, then my personal advice will be to include your child in your ILR application. Once your child is back in UK, then apply registration as British Citizen.

Thank you Asim, I want to put my question in another way and hope to get a detailed reply.

Subject: Naturalisation for a British Born Child whose parents were in UK on a Tier 1 General visa at the time of his birth.

I am currently living in UK under Tier 1 General program. My wife and 1 year old son are in UK too as my dependants. I will complete my 5 years on Tier 1 this month. My wife will complete her 2 years stay in UK with me next month so that will make both of us eligible to apply for ILR. My question is concerning my son's naturalisation. He was born in UK on 03 Aug 2011. I am under the impression that my son can be naturalised as British citizen as soon as I get my ILR - is that correct?

Next question is if our ILR application is successful (applying in person on 20th Sep) can I apply for my son's naturalisation on the same day in the same appointment?

Ideally I would like mine and wife's ILR and child's naturalisation completed when applying in person on 20th. Is that possible? Please advise best way to go about it? Regards. Maqsood

Typical immigrant problem. I have given information about each and everything you asked. Now why do you repeat the same questions again? Read my post again please. If you cannot make sense of it, then you are not capable of understanding simple statements. Get help from a legal advisor.

Asim, WTH? I was told by someone its possible. And If you don't have temprament to answer immigrants' queries then get the hell out of here. You seem to have too much time on your hands to be here on this website but without any purpose and thats pathetic. Is it not a forum where volunteers answer each others' questions without being failed-sarcastics? Such a loser you are.
