Tier 2 Sponsorship from Employer

Post by foxtrot79 » Sun Aug 19, 2012 11:19 am

Hello

I am on a Tier 1 Post study work visa and am looking to switch to a Tier 2 general visa. I have found a new job within my company that pays £31,000 and is adequate for a Tier 2 sponsorship. The company initially said they would not pay for the sponsorship and visa, but would consider it if I was willing to pay. I agreed to bear all the costs. However, the HR personnej have got back to me saying the job I obtained could not be mapped to any SCO code on the UKBA list, even though I clearly could. They also said they would'nt look at sponsoring me as they had previous negative experiences with sponsorship, even though they have a licence and the means to sponsor.

I wanted to know if it is legal and permissible for the company to deny sponsorship based on the fact that their earlier experiences were negative. Many thanks.
