Long Absences clarification required

Post by ryan2020 » Sun Aug 19, 2012 1:43 pm

Hi,

According to 10 years rule continuous residence is NOT broken if you have not spend more than 6 Months at a stretch.

while all other applications

continuous residence is broken if you spend more than 3 Months at a stretch.

whats the logic behind that ?

Proportionality. 10 years is a longer period of time in which to show your commitment to a life in the UK. Exactly twice as long.

Hi Ryan,

Very good point! Propotionality explanation doesn't really make sense for at a stretch absence, it might hold true if an applicant was allowed double the total no. Of days (180+180) number of days out of the country.

However, sadly 1+1 is not 2 when dealing with UKBA.
