Hi

My wife got ILR(Long residence) last month. I am non tier 4 student. My visa will be expire next year i mean 2013.we got married here in UK(By the way of local Register office and religiously.Its been now one year. Now i want to apply for spouse visa(FLR(m)...

Important point is i am not a under dependent visa holder of my wife.

My question is if i apply for spouse visa still i need to wait till 5 years for ILR Application ?

Please note that i am here in UK 3 years now.

Yes- you will be subject to the new income requirement and the new probationary period of 5 years.
